(b) A instigates B to murder D. B in pursuance of the instigation stabs D. D recovers from the wound. A is guilty of instigating B to commit murder.

Explanation 3- lt. is not necessary that the person abetted should be capable by law of committing an offence, or that he should have the same guilty intention or intention or knowledge as that of the abettor, or any guilty intention or knowledge.

In India, said crime is commited by a women, here in this case a Divorced women, who instigate, responsible, to murder mans wife, will not punished under this law.

Man is not a fool to kill his only wife, and ruin his marriage / family unless other women force him to commite such crime, she might have told him kill her, get rid of her, but under eyes of indian judicary thats not crime, coz she is a women.
