Only men may be tried under domestic violence act: court

Mulund metropolitan court discharges woman accused of harassing her daughter-in-law

Setting a precedent, the Mulund Metropolitan Court on Tuesday ruled that a mother-in-law could not be prosecuted under the Domestic Violence Act.

The ruling came while the court was presiding over the case of 25-year-old Priyanka Lalwani who had accused her husband Vishal (31) and his mother Sheela (51) of harassing her. Saying that only a man can be prosecuted under the act, the court discharged Sheela. Mulund metropolitan magistrate M V Deshpande cited section 2 (Q) of the act - which came into effect in October 2006 - while pronouncing the order. Priyanka had filed a case against the two earlier this year.
