Get on the fast track, HC tells trial court

Bombay High Court on Tuesday directed a Thane trial court to complete the trial of three Non-Resident Indians (NRIs) accused in a dowry case within two weeks starting from December 8.

The NRIs had approached the court seeking to get back their passports, which had been retained by the police. Dhavalshree Saraiya and his parents, who reside in the United Arab Emirates (UAE), were arrested in May when they allegedly came to India to reconcile differences with Dahvalshree’s estranged wife, Malini (name changed).

Malini left UAE and returned to her home in Mumbai in 2007 and filed a dowry harassment complaint at Mira Road police station. The accused were subsequently released on bail on the condition that they couldn’t leave India till the trial was completed.

In their application in the high court, Saraiya and his parents said their residence permit in UAE would expire if they stayed outside for more than six months. The police had opposed their plea stating that they would not come back to face trial if the passports were returned. Justice SB Mhase and AA Sayed directed the Thane court to expedite the trial and to take it up on a daily basis from December 8.
