Divorce at 82, Deserted for 40 years

THE DELHI High Court on Thursday granted divorce to an 82- year-old retired IPS officer on grounds of desertion and cruelty. The retired officer has been living separately from his wife for the last 40 years. Dismissing an appeal filed by wife Vimla Balani, 70, challenging the decree of divorce granted by a family court last year in favour of Jai Kishan Balani, Justice V.B. Gupta upheld the lower court’s observation.

“Since the marriage has broken down irretrievably and the husband has fully established his case with regard to the cruelty and desertion, the present appeal (filed by the wife) is liable to be dismissed,” Justice Gupta said, delivering the judgement.

“This court also made efforts for reconciliation but failed. The continuation of such marriage would itself amount to cruelty and as such the respondent (husband) is entitled to a decree of divorce on the ground of cruelty,” observed the court. The court also dismissed an application filed by Vimla that she was suffering from breast cancer and her husband had failed to provide her any assistance because of their marital discord. The court directed the central government health services (CGHS) several times to immediately provide life-saving drugs till the disposal of the application.

Vimla alleged that her husband did not take any steps to ensure she gets medical facility through his CGHS cover despite the court’s order. While dismissing this application, the court said since the appeal had been dismissed, her application seeking direction to her husband to provide her drugs was also being dismissed.
