Pune City court issues summons to doc, others for abortion Four including the woman and her mother have been booked

A city court has summoned a gynaecologist and two other persons for aiding a 27-year-old pregnant woman to abort the baby.

City businessman Akhilesh Daga (32), resident of Koregaon Park, had filed a private complaint in the court that his wife Deepti had aborted the child without his knowledge.Judicial magistrate (first class) Prashant Kale, who is hearing the matter, has fixed the next date of hearing on December 30.

The gynaecologist, who is attached to a reputed multi-speciality hospital,Deepti, her mother and another friend have been booked under various sections of the Indian Penal Code. The court said in its order the pregnancy of the 15.5 weeks can be terminated only when the continuance of the pregnancy would involved a risk to the life of a pregnant women or of grave injury to her physical or mental health or there is a substantial risk to health of child.
Gynaecologist Dr Subhada Deoskar, who is a member of the Pune Obstetrics and Gynaecological Society (POGS), said that she was not aware of any such complaint against her made by Akhilesh Daga.

“No notice has been served by the court yet. I need to find out,” she said. About terminating Deepti’s pregnancy she said that she has not gone against the law and since the case is quite old she was unable to recollect about the exact date of termination that was carried in 2007.

Daga’s counsel Harshad Nibalkar, Milind Pawar and PR Ghorpade had earlier filed a private complaint in the court on November 24. “Deepti told Akhilesh in May that she was pregnant and she did not want the child,” Pawar said,adding that she said that child would spoil her figure and hamper her career. Akhilesh however told her not to abort the child. Unhappy with her husband’s stand on the issue, she started picking up quarrels with him, Pawar said. Akhilesh later decided to relocate to Pune along with Deepti and they came to the city in July 2007.

After the abortion,Deepti went to Indore to her maternal uncle’s house and filed a complaint of dowry harassment against Akhilesh and his family. The Indore police arrested Akhilesh and other family members, Pawar said.
